If specific Motion services, apps, onboarding flows, partner arrangements, or commercial engagements are governed by separate contracts, service agreements, driver terms, or platform terms, those separate terms will apply in addition to, or instead of, these Terms where stated.
2. Scope of these Terms
These Terms apply to your use of the public-facing Site and any information, forms, content, branding, design, text, graphics, media, and functionality available through it.
These Terms do not, by themselves, create a transport, delivery, employment, agency, courier, consumer, or software subscription agreement unless expressly stated in a separate written or electronic agreement.
Submitting a contact request, driver interest form, or business enquiry through the Site does not guarantee acceptance, onboarding, service availability, pricing, or the formation of any contract.
3. Eligibility and acceptable use
You agree to use the Site only for lawful purposes and in a manner that does not violate any applicable law or the rights of others.
You must not:
- use the Site in any unlawful, fraudulent, deceptive, or abusive way,
- submit false, inaccurate, or misleading information,
- attempt to gain unauthorized access to the Site, servers, systems, or data,
- interfere with the operation, security, or performance of the Site,
- introduce viruses, malware, bots, scripts, or harmful code,
- scrape, crawl, data-mine, or harvest Site content or personal data without authorization,
- use the Site to send spam or unsolicited communications,
- impersonate any person or entity,
- infringe any intellectual property or proprietary right,
- use the Site in a way that could damage Motion’s reputation or operations.
4. Information on the Site
The Site is intended to provide general information about Motion and its services. While we aim to keep the Site accurate and up to date, content may contain errors, omissions, delays, or inaccuracies.
Descriptions of services, capabilities, technology, coverage, features, route optimization, dispatching, tracking, earnings, reporting, support, or other functionality are provided for general informational purposes and may change without notice.
Nothing on the Site constitutes a binding offer, guarantee, warranty, or commitment unless expressly confirmed in a separate agreement.
5. Enquiries and submissions
If you submit information through the Site:
- you represent that the information is true, accurate, current, and not misleading,
- you agree not to submit information you are not authorized to share,
- you acknowledge that we may contact you in relation to your enquiry,
- you understand that we may decline to respond, engage, or onboard at our discretion, subject to applicable law.
6. No employment or driver engagement created by the Site
Any wording on the Site relating to becoming a driver, earning income, flexible work, or joining Motion is descriptive only.
Use of the Site, submission of interest, or communication with Motion does not by itself create:
- an employment relationship,
- a worker relationship,
- a contractor relationship,
- a right to receive delivery assignments,
- a right to compensation,
- a partnership, agency, or joint venture.
Any such relationship will exist only if separately agreed in writing or through a formal onboarding process.
7. No business service commitment created by the Site
Use of the Site by a business customer, retailer, merchant, courier operator, or other organization does not by itself create a service agreement or guarantee service levels, pricing, coverage, integration, performance metrics, delivery volumes, support arrangements, or uptime commitments.
Any commercial engagement will be governed by separate agreed terms, quotations, order forms, statements of work, or service agreements.
8. Intellectual property
The Site and all content on it, including trademarks, brand names, logos, text, graphics, layouts, icons, images, software elements, and other materials, are owned by or licensed to Motion, G.A.P. Vassilopoulos Group, or their licensors and are protected by intellectual property laws.

The Site may include third-party tools, integrations, or links, including social media services, analytics, maps, embedded content, and Google reCAPTCHA.
We do not control third-party services and are not responsible for their content, availability, terms, privacy practices, or performance. Your use of third-party services may be subject to separate terms and policies.

Your use of the Site is also subject to the Motion Privacy Policy and any Cookie Policy or consent preferences made available through the Site.
11. Availability and changes
We may modify, suspend, restrict, or discontinue any part of the Site at any time, with or without notice.
We do not guarantee that the Site will always be available, uninterrupted, secure, or error-free, or that defects will be corrected.

Where liability cannot be excluded, it will be limited to the minimum extent permitted by applicable law.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded.
14. Indemnity

15. Suspension and enforcement
We may investigate violations of these Terms and take any action we reasonably consider appropriate, including restricting access to the Site, preserving records, cooperating with law enforcement, or pursuing legal remedies.
16. Entire agreement for Site use
These Terms govern Site use only and constitute the entire agreement between you and Motion regarding that subject matter, except where additional policies or separate agreements apply.
17. Severability
If any provision of these Terms is held to be invalid, unlawful, or unenforceable, the remaining provisions will continue in full force and effect.
18. Waiver
Any failure or delay by us in enforcing any provision of these Terms does not constitute a waiver of that provision or any other rights.
